To meet demands while staying cost-effective, companies need to figure out how to use technology to efficiently sort, store, and search their big data.

Cisco's Chandler was dealing with huge and growing volumes of information, partly because of the rise of IP-related calls. That's typical of enterprise consulting in the age of big data. Everyone needs to organize volumes of data, improve efficiency, and cut costs.

“If we need to search millions or billions of emails, we need homeowner database powerful search tools,” Baron thought when he was appointed to the National Archives as its first director of litigation in 2000. So began a project with Richard Braman—a multi-year research project called TREC (Text Retrieval Conference) Legal Track. The goal was to analyze the research while testing and evaluating different methods of recall, accuracy, quality control, iteration, and sampling. The need for a better way to sort, store, and organize vast amounts of data is giving rise to a new field: information management. According to the Information Governance Initiative , IG is “the activities and technologies that organizations use to maximize the value of their information while minimizing the associated risks and costs.”

Timothy Dix, CEO of Xpriori, LLC, describes e-discovery as a subset of IG. “Strong IG practices start with classification, which makes it easier to browse information in small chunks.” This means that information should be categorized by content and type to make it easier to find later. “To avoid false positives, avoid searching in large quantities. Search works best in sets of documents that are organized to a degree of homogeneity.”

The question is how to do it. “Proportionality and collaboration can only be achieved if lawyers understand how and when to use technology to find facts and limit scope before negotiations begin,” David Horrigan, an analyst at 451 Research, told Inside Counsel. He encourages teams to collaborate with IT and outside counsel. “This is not an easy change, but it is necessary to meet litigation requirements and protect clients’ interests.”

Cisco outgrew the tools they were working with. Chandler found that he needed sophisticated discovery tools that could handle large volumes of both structured and unstructured data, along with global data collection requirements. Complying with regulations and data retention requirements during eDiscovery helps departments prepare for litigation.

"While the existing program provided significant cost savings in collection and sampling, they were still sending data to hosting providers and outside lawyers to complete the final review and release of documents, which in my view no longer made sense," Chandler said.

They, like many legal departments, needed to store various types of data in their own formats. They wanted the data stored behind their firewall, with no processing limits, and with the ability to host e-discovery in the cloud.

The software can automatically cluster data according to textual and visual similarities.

“The only way litigation managers (LRMs) can ensure they have all the information they need to detect litigation is to deploy technology that automates the review of all documents and identifies those that contain little or no useful content,” Dix said.

Automating, to the greatest extent possible, tasks such as identifying all potentially relevant information, dealing with potential risks, implementing justified exceptions, and isolating potentially usable information can significantly reduce review time.

The technology is in high demand. For example, Zapproved Inc.’s new Z-Discovery platform recently received $15 million in funding from partner K1 Investment Management. The cloud-based software uses algorithms to collect the necessary data, then compresses it as much as possible.

Lighthouse eDiscovery recently raised $30 million. It cuts discovery costs by scanning legal documents for personal information like phone numbers, credit card numbers, or addresses so they can be easily redacted.

While researching their competitors, I found Ringtail , whose differentiating factor is the way it presents information for review. iConect competitor Xera is similar, for example, thumbnail previews save loading time. Internal emails with links to documents prevent the distribution of false copies of documents. And the ability to print documents with the highlight created during the initial review saves time.

It's important and challenging for firms and in-house counsel to keep track of what's happening with E-discovery. Resources like the E-Discovery team can help make this easier.
