How did the ministers position themselves?

Post by messi69 »

The rapporteur, Justice Gurgel de Faria, presented his vote on November 23. According to the judge, in the judgment of the “thesis of the century”, the STF decided, definitively, that “the concepts of revenue and income, for purposes of levying PIS and COFINS, do not include ICMS”. For the minister, the same understanding should be applied to ICMS-ST.

Justice Regina Helena Costa considered that the case being analyzed involved the same taxes analyzed by the Supreme Court, but with a different collection system in the case of ICMS. Therefore, she considered that “A mere collection system could not change what was decided within the scope of the Supreme Federal Court”.

The other ministers voted in the same jordan telegram data sense, unanimously recognizing the right of taxpayers to exclude ICMS-ST from the PIS/COFINS calculation base, precisely because the tax collected, despite being incorporated into the value of the product, is not characterized as revenue.

Conclusion
It is very important that companies are aligned with the latest developments in the tax field, since a ruling like this, for example, can represent a great opportunity to reduce the tax burden on their operations.

Tax updates occur almost daily, through regulatory changes and pending judicial or administrative judgments, which demands a lot of attention from businesspeople who intend to keep their companies in compliance and promote tax savings in their operations.

Therefore, professional support is essential, even so that this type of information is always on the radar of businesspeople, as what is at stake is the success and sustainability of the business.
