Expanding the powers of local governments in the security and defense sector

Modern challenges associated with martial law and the need to ensure national security require urgent changes in legislation. On June 18, 2024, the Verkhovna Rada of Ukraine adopted the Law of Ukraine "On Amendments to Certain Laws of Ukraine Regarding the Expansion of the Powers of Local Self-Government Bodies to Support the Security and Defense Sector of Ukraine". This law aims to strengthen the role of local authorities in supporting the security and defense sector. This analysis examines the key changes introduced by this law and their impact on the functioning of local self-government.

Restrictions on combining positions by village, settlement and city mayors. Amendments to part four of Article 12 of the Law of Ukraine "On Local Self-Government in Ukraine" prohibit heads of local councils from combining their official activities with special database other positions, except for teaching, scientific, creative activities, medical practice, instructor and referee practice in sports, exercising the powers of the head of the military administration of a settlement and entrepreneurial activity, unless otherwise provided for by the laws of Ukraine. This strengthens their concentration on the performance of their main duties and contributes to increasing the efficiency of local government.

The current issue of supporting the security and defense sector. Amendments to part one of Article 26, namely the addition of paragraph 59, give local councils the authority to provide financial and material support to the security and defense sector during a state of war or emergency. This includes approving local support programs for this sector, which allows for a prompt response to threats and the provision of the necessary resources for defense.
