On this subject, it is important to consider, as a preliminary point, that Law No. 14,133/2021 established a new legal framework for public tenders and administrative contracts. It has a very extensive text (almost 200 provisions), brought several changes to the processing of public tenders and some modifications to direct contracting and the legal framework applicable to contracts. [2] In addition, the text of the law incorporated several guidelines from external control bodies, mainly from the Federal Court of Auditors, as well as procedures and good administrative practices, previously found only in sub-legal standards. And, although there are passages similar to those contained in Law No. 8,666/1993, the fact is that it is a new law, with new text and new procedures.

In fact, scholars recommend caution when interpreting the new law, since “(…) the same words may be interpreted differently under Law 14,133/2021 than under Law 8,666/1993.” [3]

Furthermore, Article 191, §2, of Law No. 14,133/2021 itself establishes that the combination of laws is prohibited, from which it can be inferred that procedures previously provided for laos telegram data in the old bidding laws, but with no correspondence in the new law, should not be applied by analogy or in a subsidiary manner, under penalty of creating a “third” legal regime for bidding. This is as indicated by the National Chamber of Bidding Models and Administrative Contracts/AGU, through Opinion No. 00002/2021/CNMLC/CGU/AGU:

“160. This interpretation therefore seeks to reconcile the content of the rule contained in art. 189 with the final part of art. 191, which points out the impossibility of creating a 'patchwork', combining provisions of the former Law No. 8,666 of 1993 with Law No. 14,133 of 2021.

161. The final part of art. 191 also prevents any interpretation to the effect that the references contained in Law No. 8,666 of 1993 could eventually be read automatically as references to the provisions contained in the new law, by virtue of the text contained in art. 189.”

That is why the Union's Attorney Marinês Restelatto Dotti, when addressing the specific issue of the approval of the basic project or terms of reference in the new law, gives the following opinion:

“Therefore, by force of the provisions of art. 191 of Law No. 14,133/2021, in the absence of, in that diploma and in a rule (e.g., decree, normative instruction) issued for the purpose of regulating it, any provision regarding the necessary approval of the basic project or terms of reference by the competent authority, the provisions of Law No. 8,666/1993, Law No. 10,520/2002 and Articles 1 to 47-A of Law No. 12,462/2011 and their regulations will not be extended or applied to the procedural procedure for bidding and contracting governed by Law No. 14,133/2021, that is, art. 7, §2, item I, of Law No. 8,666/1993, art. 14, section II, of Decree No. 10,024/2019 and art. 8, §5, of Law No. 12,462/2011 to the new bidding regime governed by Law No. 14,133/2021.
