New SEGES/MGI Normative Instruction No. 79/2024: Updates and Impacts on Public Procurement

On September 12, 2024, SEGES/MGI Normative Instruction No. 79 was published, introducing important changes to Normative Instruction No. 73 of 2022. These changes aim to update procedures related to the application of preference margins in bidding processes, as well as introducing the possibility of a draw in cases of ties. In this article, we will address the main changes, contextualizing them with current legislation and detailing the impacts of these updates on public administration.

Main Changes Introduced by IN No. 79/2024

Draw Prediction in Case of a Tie
One of the main new features introduced by the new regulatory instruction is the provision for a draw in the event of a tie in the initial proposals, when no bids are submitted after the start of the competitive phase. Previously, the resolution of ties was restricted to previously established criteria. This measure aims to avoid possible subjectivity in the final decision and ensure greater transparency in the bidding process.

2. Updating the Percentages for Preference Margins

IN No. 79/2024 also updates the maximum percentages for calling bidders in the open/closed and closed/open modalities, when the application of preference margins is foreseen. According to Decree No. 11,890, of January 22, 2024, the percentage is now 20%. This update is significant, as it directly impacts the proposal evaluation phase in public tenders, reinforcing the incentive to contract national and sustainable goods and services.

3. SICAF and Technical Manuals

The instruction reinforces the use of the Unified Supplier Registration System (SICAF) as an essential tool in the process of registering participants in public procurement procedures. SICAF allows for a unified and simplified registration of suppliers, promoting efficiency and transparency in public procurement processes. In addition, the IN emphasizes compliance with the procedures established in the technical operational manual, which will be published by the Secretariat of Management and Innovation of the Ministry of Management and Innovation in Public Services, standardizing procedures and ensuring greater compliance in bidding processes.

Contextualization with Law 14.133/2021 and Decree 11.890/2024

Law No. 14,133 of 2021 establishes guidelines for public administration bidding and contracts, including the possibility of applying preference margins. According to Art. 26 of the Law, the preference margin may be established for nationally manufactured goods and services that meet Brazilian technical standards, as well as for recycled, recyclable or biodegradable goods. This margin may be up to 10% for goods and services that do not fall into the aforementioned categories or up to 20% for goods and services resulting from technological development and innovation in the country.

Decree No. 11,890/2024 regulates art. 26 of Law No. 14,133 and establishes criteria for the application of the preference margin in the federal public administration. It introduces concepts such as the “normal preference margin” and the “additional preference margin”, which can be cumulative, totaling a preference percentage of up to 20% for national manufactured products and national services. The decree also establishes the Interministerial Commission for Public Procurement for Sustainable Development (CICS), which will be responsible for establishing criteria, monitoring and evaluating the application of the preference margins, promoting sustainable national development through public procurement.
