A Comprehensive Guide to Electronic Signatures from a Legal Perspective. Part 1

Post by moniya12 »

When sending “red envelopes” on WeChat or making purchases on Taobao, you may initially wonder: is it safe to send or receive money with a single tap of a finger on a smartphone or a click of a computer mouse? There is no magic in this – in our time, in the era of the Internet and digital technologies, electronic signatures (ES) are increasingly being used. In addition to the e-commerce scenarios described above, there is already a widespread practice of transferring and storing files in electronic formats for business purposes. However, legal documents that have stricter reporting than e-commerce transactions – few people know how to properly draw up and certify with an electronic signature.

So in practice, when legal documents need to be formalized, people most often print them out and put their seals or signatures physically, as they have always done. This inevitably entails significant time expenditures on the execution process. Moreover, given the constant issuance of "fake seals", this labor-intensive traditional approach does not necessarily provide greater reliability.

Are electronic signatures secure?
This is due to two reasons. Firstly, due to the lack of applicable laws egypt telegram number database and regulations on electronic signatures, there are no authoritative rules to rely on in judicial practice and therefore tend not to recognize the authenticity of electronic legal documents; secondly, the general public still largely believes that electronic documents are vulnerable to forgery and therefore cannot be guaranteed to be authentic.

The Electronic Signature Law (or E-signature Law) of the People's Republic of China, enacted in 2005 and amended in 2015, provides the legal basis for determining the validity of electronic legal documents. As computer technology and cryptography advance and technology becomes more reliable in protecting electronic documents from forgery, public perception is gradually changing, which will hopefully one day lead to the popularity of electronic legal documents.
